Punishment for using a false trade-mark or property mark:

Whoever uses any false trade mark or any false property mark shall, unless he proves that he acted without intent to defraud, be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

Offence	Cognizance	Summons / Warrant	Bailable / Not Bailable	Compoundable or Not	Punishment	Triable By
Using a false trade or property mark with intent to deceive or injure any person.	Shall not arrest without warrant	Warrant ..	Bailable..		Imprisonment of either description for 1 year, or fine, or both.	Magistrate of the first or second class

Offence: Bailable.. --- Using a false trade or property mark with intent to deceive or injure any person.

Punishment--- Imprisonment of either description for 1 year, or fine, or both.
