Section 120-B. Punishment of criminal conspiracy.

(1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, [imprisonment for life] or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.

(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.

Criminal conspiracy to commit an offence punishable with death, [--] or rigorous imprisonment for a term of two years or upwards. May arrest Without warrant if arrest for the offence which is the object of the conspiracy may be made without warrant, but not otherwise. According as a warrant or summons may issue for the offence which is the object of the conspiracy. According as the offence which is the object of the conspiracy is bailable or not. Not Compounable The same punishment as that provided for the abetment of the offence which is the object of the conspiracy. Court of Session when the offence which is the object of the conspiracy is triable exclusively by such Court: in the case of all other offences Court of Session, [**] or Magistrate of the first class.
Any other criminal conspiracy. Shall not arrest without a warrant. Summons Bailable .. Ditto Imprisonment of either description for six months or fine, or both Magistrate of the first class.

Offence: According as the offence which is the object of the conspiracy is bailable or not. --- Criminal conspiracy to commit an offence punishable with death, [--] or rigorous imprisonment for a term of two years or upwards.
Punishment--- The same punishment as that provided for the abetment of the offence which is the object of the conspiracy.
Offence: Bailable .. --- Any other criminal conspiracy.
Punishment--- Imprisonment of either description for six months or fine, or both
