Section 59: Arrest by Private Persons and Procedure on Such Arrest

(1) Any private person may arrest:

  • A person who, in their view, commits a non-bailable and cognizable offence; or
  • Any proclaimed offender.

Such a private person shall, without unnecessary delay, hand over the arrested individual to a police officer or, in the absence of a police officer, take or cause the person to be taken into custody to the nearest police station.


(2) If there is reason to believe that the arrested person falls under the provisions of Section 54, a police officer shall re-arrest them.


(3) If there is reason to believe that the arrested individual has committed a non-cognizable offence and:

  • The individual refuses to provide their name and residence on the demand of a police officer, or
  • Provides a name or residence that the officer reasonably believes to be false,

the individual shall be dealt with under the provisions of Section 57.

If there is no sufficient reason to believe that the person has committed any offence, they shall be released immediately.
