Consult a family lawyer to help you file the correct documents and handle the Union Council process. Before filing for divorce, trying counseling or mediation can help you and your spouse find a better way to handle differences, focus on the child’s needs, and possibly avoid the negative consequences of conflict. Protects the Child’s Well-being: Divorce or separation can be emotionally tough on children. Counseling helps parents communicate better and reduce conflict, which creates a more stable environment for the child. Promotes Amicable Solutions: Mediation encourages both spouses to discuss issues calmly and reach mutually acceptable agreements regarding custody, visitation, and financial support without lengthy court battles. Saves Time and Money: Avoiding court reduces legal fees and speeds up the resolution process, which is less stressful for the whole family. Preserves Respect and Cooperation: Counseling can help maintain respect between parents, which is crucial for co-parenting and the child’s emotional security. Legal Benefit: Courts often appreciate efforts to settle disputes amicably and may consider mediation agreements when issuing custody or support orders.

ASSALAM-0-ALAIKUM, You can give verbal divorce/talaq to your wife than submit an application (provide details of talaq) to your area's UC Chairman. UC Chaiman will call you and your wife/her representative and would try reconciliation between you two. If any of you refuse to continue the marriage than UC Chairman will legalize the divorce. (All this will be done within 30 days). Please Note that under Muslim Family Law Ordinance 1964, your talaq would be legally recognized after 90 Days from the day you give Talaq to your wife, including 30 Days of UC Chairman's procedure. You cannot give your wife Talaq if she is pregnant. OR Hire a lawyer, File a divorce case in the Family Court and take Talaq from there. (Period of 90 Days would still be assumed to legally establish the talaq). You can ask for child's custody in same case or file a new case for the custody. Your Choice
