PETITION UNDER SECTION 497 Cr.P.C FOR GRANT OF POST-ARREST BAIL

Respectfully Sheweth:

That the Petitioner has been falsely and malafidely implicated in the above-referred FIR with ulterior motives. The said FIR is annexed herewith for kind perusal. This is the first petition for post-arrest bail being submitted before this Honourable Court on the following grounds:

GROUNDS

A. That the Petitioner has been falsely implicated by the complainant with malafide intent and without lawful justification.

B. That during the course of successive investigations, no incriminating evidence has been brought on record against the Petitioner to establish his involvement in the alleged offence.

C. That the complainant has personal enmity with the Petitioner and is exerting undue pressure to disrupt his business and extort money.

D. That the Petitioner is facing significant financial hardship and is unable to meet the unwarranted and illegal demands of the complainant.

E. That, as a result of the aforesaid dispute, the complainant has initiated false and frivolous criminal proceedings with intent to blackmail and harass the Petitioner.

F. That the allegations under Section 3/6–3/7 of the P.C.A, 1977, are baseless and form part of a malicious campaign orchestrated by the complainant.

G. That no admissible or reliable evidence has been produced by the prosecution that connects the Petitioner to the commission of the alleged offence.

H. That the Petitioner is a law-abiding and respectable citizen with no criminal record and has no concern with the alleged offence.

I. That continued detention of the Petitioner shall result in irreparable loss to his personal liberty, dignity, and reputation.

J. That the Petitioner is ready and willing to furnish surety to the satisfaction of this Honourable Court and undertakes to comply with all conditions imposed by the Court.

PRAYER

In view of the foregoing, it is most respectfully prayed that this Honourable Court may graciously be pleased to accept this Petition and grant post-arrest bail to the Petitioner till the final disposal of the case, in the interest of justice.
